Major Shake Up of Planning Rules Comes Into Effect

On the 30 May 2013 extensive changes to permitted development rights including measures allowing offices to be converted into homes without planning permission were introduced.

The changes to the General Permitted Development Order also included a significant increase in the limits of household extensions and rules to enable the conversion of existing buildings including offices, hotels, care homes, cinemas and concert halls to state-funded schools without the requirement of planning consent.

Prior to the introduction of the new rules the communities secretary Eric Pickles commented that they would help “put to good use” the “many disused existing buildings we have”.



He also added: “By simplifying the process and relaxing some stringent rules we can provide a helping hand to those eager to boost their high streets or rural communities by cutting the time and costs needed to start up new businesses.”

Permitted development: Key changes

Premises with a B1(a) office use will be entitled to change to C3 residential use although prior approval will be required from the council who will be considering the impact of the change of use on flooding, highways and transport issues and contamination.

Premises in B1, C1, C2, C2A, D1 and D2 use classes will be entitled to change use permanently to a state-funded school again subject to the council approving the change having considered highways and transport issues The size limits and percentage increases for home and business extensions are to be doubled for a period of three years.

Agricultural buildings which are under 500 square metres will be allowed to change to A1, A2, A3, B1, B8, C1 and D2. Again council approval is needed having considered flooding, highways and transport impacts and noise. Buildings with use classes A1, A2, A3, A4, A5, B1, D1 and D2 will be allowed to change use for a period of up to two years to A1, A2, A3 and B1 in order to assist with starting up new businesses.

The permitted development thresholds for business change of use will be increased from 235 square metres to 500 square metres for change of use from B1 or B2 and from B2 or B8 to B1.
