2013: Beware if selling to consumers

If your business sells to consumers, there have been some key changes in 2013.

Tighter rules on payment surcharges took hold from April. Following pressure from consumer groups and reflecting EU legislation, charges for using credit or debit cards in excess of those incurred will be banned in all consumer contracts for goods, services, and digital content. But some limited exceptions will survive, and businesses with less than 10 employees will have longer to comply.



Further pressure on unfair terms in consumer contracts is expected in the spring when the Law Commission reports its findings. Detailed observations and proposals to government are expected to focus on areas currently exempt under existing legislation, which if adopted would offer consumers greater protection.

Tougher consumer remedies for poor digital content could be on the horizon if the BIS gets its way, with a proposal for inclusion within existing sale of goods legislation. Specific quality standards may apply if adopted. Service standards are also due for an overhaul with suggestions for a specific time period for completion when delivered to consumers.
